These products are distributed by the Medical Tourism
Association, Inc. and managed by Global Healthcare Resources, Inc. and fall under the below Terms &
Conditions:
All companies, entities, and individual professionals purchasing the Subscription for the Medical Tourism
Calculator and Medical Tourism Index must abide by the Subscription Terms and Conditions including but not
limited to:
- Credit Card Policy
- Auto-Renewal Policy
- Relinquishment Policy
- Other Terms and Conditions
For purposes of this agreement and Terms & Conditions, Medical Tourism Association, Inc. shall be referred
to hereinafter as “MTA”.
PRODUCT DESCRIPTION
Our online products are stored in a system-based account granting access to our customers for easy and
secure management.
Medical Tourism Calculator (MTC)
This online adaptable tool is used to demonstrate economic impact of medical travel in various countries with
variable circumstances.
This product comes with a three (3) month, six (6) month, or annual subscription and
is set up in an auto-renewal billing cycle of every three (3), six (6), or twelve (12) months (note that not all
terms may be currently available to choose from at the time of purchase. The payment will be automatically
deducted from the credit card on file.
Medical Tourism Index (MTI)
This online tool measures and compares consumer perception of medical tourism amongst leading destinations.
This product comes with a three (3) month, or annual subscription and at the end of this period access
to the system will be automatically relinquished, unless requested to be extended in writing, and then
repurchased.
Access to the Medical Tourism Index and Calculator online accounts are
sent shortly after purchase. Online account access is strictly only to the account owner. Sharing access
information is strictly prohibited. Violation of this condition is subject to the immediate
relinquishment of the online access to the platform.
Bundle Policy
Purchase of the Medical Tourism Index subscription plan includes a bundled access to the Medical Tourism
Calculator that lasts for the duration of the Medical Tourism Index plan; the expiration of the Medical Tourism
Index package ends access to both products at the same time. The Medical Tourism Calculator may be purchased as
standalone product.
The customer can choose to continue with the subscription on either product after the first subscription term
following the renewal and relinquishment guidelines.
Failure to adhere to the Bundle Policy, including the following Detailed Bundle Guidelines, may result in the
account suspension. MTA reserves the right to modify or revoke this policy at any time.
Relinquishment Policy
The subscription to the Medical Tourism Calculator comes with an auto-renewal and auto-billing
policy and can be canceled by sending a written request to our Client Compliance / Retention Team at [email protected]. Cancellations may not be taken over the telephone.
To avoid paying for any upcoming fees notification of cancellation must be provided fifteen (15)
days written notice prior to the renewal date for the subscription. Failing to follow this process
grants us cause to collect payment. Fees will not be refunded under any circumstances.
The
subscription to the Medical Tourism Index will be automatically relinquished at the end of the
subscription plan purchased. To continue with this product and the access to the online account a written
renewal notification must be provided to continue with the subscription. Contact our

The
bundle can be cancelled or relinquished in accordance with the guidelines for each product
category.
BILLING AND PAYMENTS
Credit Card Policy
A valid debit or credit card must be used by each customer for the purchase of the Medical Tourism Index and
Medical Tourism Calculator’s Subscription. In all cases, the credit card must remain on file for the duration of
the Subscription period to retain access to the online accounts. Only properly relinquishing or
canceling your subscription will effectuate the termination of service and in accordance with the
Relinquishment Policy. Credit cards will only be charged in accordance with the terms of
the Medical Tourism Index and Medical Tourism Calculator’s Subscription as described below.
- At checkout, you will select the desired product or the bundle package, with the desired subscription
period.
- Upon entry of credit card information, credit cards will be validated by the system, prompting the customer
of any error or a problem with the card in use, allowing the reentry of another valid card, if needed.
- Renewals for these products will be charged to the credit card on file based upon the length of the
subscription plan purchased.
- Failure to maintain a current credit card on file will prohibit access to the online accounts, and you will
need to contact the Client Success Team to re-activate your account by sending a request to [email protected]. We accept the following credit cards:
American Express, VISA, MasterCard, and Discover Card.
Auto-Renewal and Auto-Billing Policy
MTA products come with a Subscription to an online account under auto-renewal and auto-billing policy as defined
at the point of purchase and herein. MTA is not obligated to send the customer any renewal or advance billing
notices, or other notices indicating that your debit or credit card will be or has been charged. A courtesy
e-mail will be sent as the receipt of payment after the payment has been made.
It is the customer’s
responsibility to maintained valid cards on file and to replace expired or any card that is no longer authorized
and/or expired.
Customers may replace the credit card on file at any time. If a card is removed but not
replaced, there will be no access to the Subscription online account until a new valid credit card is added and
validated by the system. Removing a debit or credit card from the system does not release you from
the liability for any outstanding or upcoming fees, nor from canceling the subscription to the online
account following the relinquishment process.
If the required payment method fails
or the account is past due, MTA may collect amounts owed by obtaining other payment methods provided by the
customer, or by retaining collection agencies and legal counsel. MTA may also report information about your
account to credit bureaus, and as a result, late payments, missed payments, or other defaults on your account
may be reflected in your credit report. If you wish to dispute the information MTA reported to a credit bureau
(i.e., Experian, Equifax, or TransUnion) please contact us at Medical Tourism Association, Inc. 4371 Northlake
Boulevard, Suite 304, Palm Beach Gardens, Florida, 33410. If you wish to dispute the information a collection
agency reported to a credit bureau regarding your account, you must contact the collection agency directly.
MTA
reserves the right to immediately and without notice, either suspend or terminate your subscription for
unauthorized use of the program marks or misrepresentation of our products subscription in accordance with the
Terms & Conditions of these products.
You will also be required to pay any amounts still owed to MTA
at the time your account is suspended or terminated.
OTHER TERMS & CONDITIONS FOR PRODUCTS SUBSCRIPTION
Promotional E-Coupons
Promotional coupons are designated for groups or individuals to access the products Subscription to the online
accounts through a partial or a full discount. However, customers must abide by the products guidelines,
relinquishment policy, and auto-renewal and auto-billing policy. A valid debit or credit card must
remain on file for the duration of the program to retain access to the Subscription to the online account; and
pay for any renewal fees. This is irrespective of promotional coupons being utilized. If a promotional
coupon applies a partial or fully prepaid amount, the discount applies only to the initial product purchase
and not to the renewal fees. Again, a credit card will need to be entered at the time of enrollment
to comply with the auto-renewal and auto-billing process irrespective of any discount or complimentary initial
offer. Customers will not be exonerated from any future renewal fees.
If the subscription to any of our
products is no longer needed, it must be canceled following the relinquishment process as indicated in these
terms.
COVENANTS & AGREEMENTS
I covenant and agree that:
- Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT WILL MTA BE
LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT
LIMITATION ATTORNEY’S FEES, LOSS OF BUSINESS, REVENUE, PROFITS OR OTHER ECONOMIC ADVANTAGE, HOWEVER CAUSED,
REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF OR RELATED TO THE USE OR THE INABILITY TO USE ANY OF
GHR’S MARKS, INCLUDING WITHOUT LIMITATION THE IMPLEMENTATION OF THE FORMS OF DISCIPLINE, EVEN IF MTA HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL MTA’S LIABILITY UNDER THIS DECLARATION AND
AGREEMENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE AND DEFAMATION) OR OTHERWISE, EXCEED THE AMOUNT
PAID IN PURCHASE FEES. LIABILITIES SHALL BE LIMITED AND EXCLUDED, EVEN IF THE REMEDY FAILS OF ITS
ESSENTIAL PURPOSE.
- Miscellaneous
A. Integration. My purchase of subscription plan, these Terms, and the
documents incorporated herein by reference constitute the complete agreement and supersede all prior or
contemporaneous oral or written representations and warranties. MTA may modify these Terms upon notification
to me. No modification by me to these Terms shall be binding upon MTA unless in writing and signed by
MTA.
B. Assignment. I will not assign or transfer any of my rights or obligations
under these Terms. Any assignment or delegation by me of these Terms or any of my rights or obligations
hereunder shall be null and void. MTA may assign its rights herein, without my prior
consent.
C. Relationship. My relationship with MTA is that of a subscription
holder and in no way does the relationship constitute an independent contractor, partnership, franchise,
joint venture, agency or employment relationship.
D. Interpretation. These Terms,
which I understand are binding upon me in consideration of MTA processing my purchase, shall be interpreted
in such a manner as to aid in effectuating the purposes and business of MTA. No third-party private right of
action shall be permitted against MTA for acts or omissions taken by MTA in the furtherance of its purposes
and business or in connection with these Terms. Failure of MTA to insist on strict performance of the
provisions contained herein does not prevent MTA from later enforcing its rights under these Terms.
E.
Choice of Law; Forum. These Terms and any action relating thereto shall be governed by and
construed and enforced in accordance with the state of Florida, Palm Beach County and controlling U.S.
federal law. No choice of law rules of any jurisdiction will apply. I will not bring any action arising from
or related to these Terms except in a court of appropriate subject matter jurisdiction in the State of
Florida, Palm Beach County, and I expressly consent to personal jurisdiction and proper venue by and in such
court.
F. Headings; Severability. The headings of sections and paragraphs herein
are for convenience of reference only and are without substantive significance. In the event that any
provision of these Terms shall for any reason be held invalid, illegal or unenforceable in any respect, such
validity, illegality or unenforceability shall not affect any other provision and these Terms shall be
interpreted and construed as if such term or provision, to the extent the same shall have been held to be
invalid, illegal or unenforceable, had never been contained herein.
